1. Introduction

These Terms and Conditions govern your use of missioneartista.com (the "Website") and the services offered by Jervé — Gustavo Alberto Palumbo ("the Artist"). By accessing this Website or engaging any of the services described herein, you agree to be bound by these Terms.

The Artist operates internationally, with bases in Spain and Italy. All services are offered on a private, by-referral or direct-enquiry basis unless otherwise stated.

2. Services

The Artist offers the following services and products:

• Original commissioned artworks — painted portraits and works on paper, executed to individual commission using original protocols developed by the Artist (Verba, DUO, Limen, The Absent Sitting, Polaroil).
• Private portrait commissions — bespoke portraiture services for private clients, conducted under strict confidentiality agreements.
• Digital content — online courses, publications, ebooks, and educational materials offered through the Website or associated platforms.
• Newsletter and communications — subscription-based updates regarding the Artist's work, publications, and events.

3. Commissioned Artworks

All commissioned works are unique, hand-executed originals. Each commission is subject to a separate written agreement between the Artist and the client, which will specify scope, timeline, payment terms, and delivery conditions.

A non-refundable deposit is required to initiate any commission. The precise amount will be agreed in writing prior to commencement of work.

The Artist retains the right to reproduce images of completed works for portfolio, exhibition, and promotional purposes unless a specific confidentiality agreement has been signed. In the case of private commissions conducted under the protocols Verba, DUO, Limen, and The Absent Sitting, confidentiality terms are agreed individually and in writing with each client. The Artist undertakes to honour all such agreements without exception.

Ownership of the physical artwork transfers to the client upon receipt of full payment. Copyright and all reproduction rights remain with the Artist unless explicitly transferred by written agreement.

4. Private Commission Protocols

The protocols Verba, DUO, Limen, and The Absent Sitting involve the collection and use of personal material — including photographs, written reflections, and session recordings where applicable. All such material is handled with absolute discretion and used exclusively for the purpose of executing the commissioned work.

No personal material belonging to the client will be shared with third parties, stored beyond the duration of the commission, or used for any purpose other than that explicitly agreed. Upon completion and delivery of the commissioned work, all source material is deleted or returned to the client as agreed.

Session recordings, where used, are subject to a separate Non-Disclosure Agreement signed prior to commencement.

5. Digital Products and Courses

Digital products — including ebooks, online courses, and downloadable materials — are delivered electronically upon receipt of payment. Due to the nature of digital goods, purchases are non-refundable once the content has been accessed or downloaded.

All digital content is protected by copyright. Purchasers are granted a personal, non-transferable licence for private use only. Reproduction, redistribution, or commercial use of any digital content is strictly prohibited without prior written consent from the Artist.

6. Payments

Prices for all services and products are communicated directly to the client prior to any transaction. The Artist reserves the right to adjust pricing at any time; however, any price agreed in writing for a specific commission or product will be honoured.

Payments for commissions are structured in instalments as agreed in the individual commission agreement. Failure to meet payment terms may result in the suspension or cancellation of the commission, with any deposit already paid being non-refundable.

7. Delivery and Shipping

Physical artworks are shipped by specialist fine art couriers with full insurance. Shipping costs are agreed in advance and are the responsibility of the client unless otherwise stated in the commission agreement.

Risk of damage or loss passes to the client upon handover to the courier. The Artist recommends that clients maintain appropriate fine art insurance upon receipt of works.

8. Intellectual Property

All content on this Website — including but not limited to images of artworks, texts, photographs, and design elements — is the intellectual property of Jervé — Gustavo Alberto Palumbo and is protected by applicable copyright law.

No content may be reproduced, copied, distributed, or used for any commercial purpose without prior written permission from the Artist.

9. Privacy and Data Protection

The Artist is committed to protecting the privacy of all clients and Website visitors. Personal data collected through this Website — including contact information and newsletter subscriptions — is used solely for the purpose for which it was provided and is never sold or shared with third parties.

10. Limitation of Liability

The Artist makes every effort to ensure the accuracy of information provided on this Website. However, no warranty is given as to the completeness or accuracy of any content. The Artist shall not be liable for any loss or damage arising from reliance on information contained on this Website.

The Artist's total liability in connection with any commission or service shall not exceed the total amount paid by the client for that specific commission or service.

11. Governing Law

These Terms and Conditions are intended to operate internationally. In the event of any dispute arising from or related to these Terms or any service provided by the Artist, the parties agree to seek resolution through good-faith negotiation in the first instance. Where legal proceedings become necessary, the parties agree to submit to the jurisdiction most appropriate to the circumstances of the dispute.

12. Amendments

The Artist reserves the right to amend these Terms and Conditions at any time. Any changes will be reflected on this page with an updated date. Continued use of the Website or services following any amendment constitutes acceptance of the revised Terms.
